1. Scope of Services
Velora Luxx operates solely as a material supplier and project coordinator. Services include sourcing materials, design consultation, and coordination of project elements. Velora Luxx does not perform construction, installation, or trade work.
2. Payment Terms
A 30% deposit is required to initiate all projects and secure materials. Additional progress payments may be required prior to installation. The remaining balance is due upon completion unless otherwise agreed in writing.
Project scheduling, material ordering, and fabrication will not begin until required payments are received.
3. Deposits & Refunds
All deposits are non-refundable once materials have been ordered, fabricated, or allocated to the project. Due to the custom nature of materials, cancellations may result in forfeiture of deposit.
4. Contractors & Third-Party Services
All installation and related services are performed by independent third-party contractors. These services may include, but are not limited to, fabrication, installation, plumbing, electrical work, and permitting.
All contractors are solely responsible for their respective scope of work, including means, methods, safety, supervision, scheduling, licensing, insurance, and compliance with applicable laws and regulations.
Client acknowledges that contractors may be contracted directly or indirectly and that Velora Luxx does not guarantee or warrant contractor performance.
Velora Luxx shall not be considered a general contractor, builder, or employer of any contractor.
5. Limitation of Liability
To the fullest extent permitted by law, Velora Luxx shall not be liable for any damages, losses, claims, or expenses arising out of or related to contractor work, construction activities, job site conditions, or any damage to property.
Velora Luxx shall not be responsible for any direct, indirect, incidental, consequential, or special damages, including but not limited to delays, installation issues, or third-party performance.
6. Materials & Natural Variation
All materials, including natural and engineered stone products, are subject to variation in color, veining, pattern, texture, and finish. These variations are inherent and are not considered defects.
7. Installation & Site Conditions
Client is responsible for ensuring the job site is prepared, accessible, and ready for installation. Velora Luxx is not responsible for delays or issues arising from site conditions, contractor scheduling, or third-party coordination.
8. Changes & Change Orders
Any changes to scope, materials, or design after approval must be documented and approved. Additional costs and timeline adjustments may apply.
9. Delays & Non-Payment
Failure to make scheduled payments may result in delays, rescheduling, or suspension of services. Velora Luxx shall not be liable for any resulting project delays.
10. Warranty
Velora Luxx provides a limited one (1) year coordination warranty related to material supply and project facilitation. Any warranties related to installation or labor are provided solely by the contractor or manufacturer.
11. Governing Law
These terms shall be governed by the laws of the State of Arizona.
